The General Data Protection Regulation (GDPR), which came into force on 25 May 2018, establishes specific obligations in relation to data, particularly for all businesses operating in the European Union. IZIPIZI is therefore subject to this regulation and is committed to protecting your personal data. This privacy policy (the “Policy”) is designed to provide you with all information necessary for understanding how we use your data.
IZIPIZI may amend this Policy at at any time. We therefore recommend you regularly check back on it. In the event of substantial changes being made to the Policy in relation to your rights, IZIPIZI will draw your attention to these as soon as reasonably possible.
1. Who processes your data?
The company IZIPIZI, a “SAS” [simplified joint-stock company] with registered capital of €50,000 and head offices at 19 Rue de Calais 75009 Paris. We offer manufacturing services for spectacles that you can buy online at the website accessible at the address <izipizi.com> and in store.
During use of these services, IZIPIZI may, as the data controller, process personal data relating to visitors to the website, as well as customers and prospective customers for the service (“Personal Data”).
2. Which data do we process?
IZIPIZI collects personal data in the following ways:
• directly from you:
? when a customer account is created, we save all the information required to place an order, namely your full name, email address, postal address and telephone number;
? when signing up for our newsletter;
? when you use our contact form: data provided in the form (email address and any personal data you choose to include in the free text field);
? when you use our website: data that can be used to identify and authenticate you (connection logs, IP address), data related to purchases, your browsing behaviour on the site, times and dates of visits to the site, localization data.
• indirectly:
? through social networks such as Facebook, Instagram and Twitter: data are liable to be exchanged between IZIPIZI and social networks when, for example, you visit the website and are simultaneously logged into these social networks on your device. These exchanges can be prevented by logging out of social media before visiting the IZIPIZI website;

3. Why do we process your data?
IZIPIZI uses your data:
• when this is necessary to fulfil our contract with you or for the execution of pre-contractual measures taken at your request, notably when:
? creating your customer account;
? managing your orders, for their tracking and invoicing;
? sending product availability notifications;
? managing communications and exchanges, notably in the event of disputes;
? managing electronic newsletters, SMS and commercial offers;
? monitoring your satisfaction;
? managing any requests to exercise your rights applicable within the framework of the GDPR.
• When this is necessary to enable us to fulfil our legal and regulatory obligations, notably when:
? managing the risks related to fraudulent use of your data. IZIPIZI takes every precaution we deem useful to ensure the security of your data and our information systems, and to defend our interests. These measures may, where necessary, lead to suspension of your online account;
? managing any disputes, notably linked to the recovery of any sums owed to us and when managing payment incidents;
? fulfilling our legal obligations or complying with applicable legislation, such as government requests (such as fiscal administration).
• When we have a legitimate interest, to promote and improve our services, for operations related to sales prospecting or for the completion of studies, with respect for your rights, and, notably:
? when you visit our website, we record your visits in order to show advertising when you browse other websites. Neither the advertising agencies nor the third party sites displaying our advertising have access to your personal data. ? to improve our services and the relevance of our offers, we use software and services operated by third-party providers that enable us to better understand our business. To this end, we provide these programs with access to data in our customer database, your browsing history on our website, and information on the products ordered.
• When you have given your permission. In this case, you can retract your permission at any time, without this having any retroactive effect. This is notably the case for our weekly newsletter, which you can unsubscribe from at any time by clicking on the link “me désabonner” (unsubscribe) at the bottom of the newsletter or directly from the website in your customer account in the section “mon compte/vos données personnelles” (my account/your personal data). This will have immediate effect.
4. Who has access to your data?
Your data are accessible to authorized IZIPIZI staff.
Your order information is sent to the various service providers involved in ensuring your order reaches you, namely our logistician who prepares the package and the shipping company who delivers it to your address.
They are in no way permitted to use your data for any purpose other than the processing of your order and must delete this data from their information systems once the order has been processed. These service providers store the data in data centers in Europe.
If, however, you opt for delivery outside Europe, your data and postal address will need to be sent to the logistics department of the shipping company that will deliver your order in this country.
We also use a French service provider for our newsletters which is ISO-27001 certified. To this end, they guarantee that data is stored in maximum security.
Our service provide Diduenjoy receives your email address, full name, and order reference number for the sole purpose of sending you a satisfaction survey to assess your purchasing experience on the IZIPIZI website.
Our service provider DND has access to your personal data as part of its tasks to develop and maintain our website.
In order to personalize your experience and improve your navigation on the site, your data may be transmitted to our various partners, including AB Tasty, Adobe, Beyable, and Content Square.
Finally, as part of our advertising activities and for statistical analysis purposes, your data may be shared with our various partners, including Bing, Criteo, Google, Meta, Bytedance, Salecycle, or Splio. It is important to note that each data exchange with our partners is subject to good practices in data protection under the General Data Protection Regulation.
5. How long are your data stored?
Your personal data are stored for as long as required for the purposes outlined above, plus the legal limitation period.
Your account data (registration) are therefore stored for the duration of your membership. They can then be stored for three years following your last contact, notably to enable us to send you commercial offers.
Your personal data may be stored for a longer period in response to specific legal obligations or in respect of applicable legal provisions. For example, data can be stored for:
• ten years for accounting purposes;
• Throughout the duration of a dispute until all avenues of appeal have been exhausted.
6. What security measures are in place to protect your data?
In accordance with the GDPR and the applicable legislation, IZIPIZI has put in place appropriate technical, physical, and organizational measures to ensure the security and confidentiality of Personal Data and to prevent these from being distorted, damaged, or accessed by unauthorized third parties.
Additionally, IZIPIZI chooses its sub-contractors and service providers carefully, and the latter must provide guarantees in terms of quality, security, reliability, and resources that enable implementation of these security measures.
7. Do your data leave the European Union?
The servers for the IZIPIZI website are hosted exclusively by OVH, in France, in data centers in the north of France. These servers contain our databases required for operating the <izipizi.com> website and information on customer accounts.
Some of our statistics tools operate in the United States. All data handled for statistics purposes outside of Europe are nonetheless fully anonymized.
8. What rights do you have over your data?
In accordance with data protection regulations, you have rights at any time, without incurring any costs, to access, rectify, and erase your Personal Data, subject to the rights and liberties of third parties and the obligations incumbent upon IZIPIZI. You also have the right to set out directions relating to the use of your data after your death.
Note that you can amend most of your Personal Data yourself in your customer space.
For access rights, we may also request payment of reasonable fees based on administrative costs for any additional copies of data than those you will be sent.
In certain cases, you also have the right to limit processing of your Personal Data and to its portability. You can also ask to exercise your right to oppose the processing of your personal data, for reasons related to your personal circumstances, when processing is based on the legitimate interest of the data controller, including profiling. In the event that this right to opposition is exercised, IZIPIZI will cease processing unless there exist legitimate, pressing reasons for the processing that prevail over the interests, rights, and liberties of the person in question or for the reporting, exercising, or defence of a legal right. You can also at any time oppose all processing related to prospecting activities (including profiling linked to such prospecting activities) and withdraw your consent when this is the legal basis for processing (the withdrawal of consent will have no consequence on the legality of the processing completed before withdrawal of consent).

This Privacy Policy (the “Policy”) governs the collection and handling of personal information on this website and any related mobile applications (collectively, the “Site”), which is operated by IZIPIZI USA (“IZIPIZI”, "we", "us" or “our”).

IZIPIZI utilizes shared services and technology infrastructure of IZIPIZI that may result in your data being shared with all branded businesses within IZIPIZI. This data may be used for data analytics, customer service and other operational purposes. We do not allow your personal information to be used for cross-brand marketing by IZIPIZI’s other branded businesses or in any other way that violates our Privacy Policy.
IZIPIZI’s policy is to prohibit the unlawful disclosure of your personal information. IZIPIZI may disclose personally identifiable information you provide to third parties if you grant IZIPIZI permission to do so, if it is required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) complete the request for information, such as providing you with information on IZIPIZI that you request; (b) comply with legal process; (c) enforce the Policy; (d) respond to claims that any information you provide violates the rights of third parties; (e) protect the rights, property, or personal safety of IZIPIZI, its users and/or the public; or (f) in relation to the sale, assignment, transfer or acquisition of all or substantially all of IZIPIZI’s assets or shares by a third party.

IZIPIZI does not share your personal information with third parties in exchange for money.

Accessing, Correcting or Deleting your Data

Computer/Device Information
IZIPIZI logs your current Internet address (this is usually a temporary address assigned by your Internet service provider when you log in), the type of operating system you are using, and the type of browser software used. In addition, IZIPIZI may keep track of what portions of this Site you are visiting. IZIPIZI aggregates this information to help IZIPIZI improve or create a better experience for users of the Site. For example, IZIPIZI may upgrade those parts of the Site that are heavily visited.
Our Site automatically records website usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the site. We do not use this information to track or record information about individuals. We will disclose this information to third parties only in aggregate form or as may be required by law. For the purpose of enabling better website design and a better user experience, we employ Google Analytics (a web service of Google, Inc.) to track site traffic and provide aggregate reports of how the public interacts with our Site. Session cookies are employed by Google Analytics in the form of client-side JavaScript code. In utilizing this analytics service, IZIPIZI maintains its existing standards in regard to the sharing and disclosure of information, security and privacy safeguards for the data, and the data retention policy, each described below. Google Analytics analyzes website usage information automatically upon visits to the Site. Users who do not wish to have their visit information collected by Google Analytics may opt-out by downloading a browser extension or by disabling cookies in their browser settings. Opting-out of web measurements will still permit users to access the full Site, with all included information and functionality.

Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different websites when you visit this Site.
H. Our Use of Google Analytics
We use a tool called “Google Analytics” to collect information about use of this site. Google Analytics collects information such as how often users visit or use the Site, what pages users visit when they do so, and what other sites user used prior to coming to the Site. We use the information we get from Google Analytics to improve the Site. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

K. Children’s Privacy and Age Limitations for the Site
The Site is intended for use by persons aged 18 or older, and by your use of this Site you affirm that you are at least 18 years of age. We do not knowingly collect personal information from children under the age of 18. If we discover or are made aware that we have received personal information from an individual who indicates that he or she is, or whom we otherwise have reason to believe is, under the age of 18, we will delete such information from our systems. If you are a parent or legal guardian of a child under the age of 18 and believe that your child has disclosed personal information to us we welcome you contacting us as provided below so that we can address such matter.
From time to time there may be instances when we collect information through the Site about children under the age of 18 but we will only do this when such information is provided to us by that child’s parent or legal guardian. In all cases where we’ve collected information about a child under the age of 18, the parent or legal guardian may contact us as provided below to review and request deletion of such child's personal information as well as to prohibit the further use of such information by us.

M. Your California Privacy Rights
The following additional privacy notices for California residents (the “California Notice”) supplement the information contained in the other portions of this Policy and apply solely to individuals who reside in the State of California (“California consumer” or “you”). IZIPIZI adopts this California Notice to comply with the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and their related regulations (collectively the “CCPA”) and other applicable California laws.

Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer, household or device (collectively, "personal information"). Exercising Your CCPA Rights and Choices
The sections below describe how you may exercise your rights under the CCPA.
Access to Specific Information and Data Portability Rights.
You have the right to request that we disclose certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable consumer request (see “Exercising Access, Data Portability and Deletion Rights” below), we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting that personal information.
- The categories of third parties with whom we share that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).

As allowed by the CCPA, we do not provide these access and data portability rights for business-to-business personal information.
Deletion and Correction Request Rights.
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see “Exercising Access, Data Portability, Deletion and Correction Rights” below), we will delete (and direct our service providers to delete) your personal information from our (and service provider) records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products or services to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another California consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with California consumer expectations based on your relationship with us, such as future field campaigns or product safety issues.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
As allowed by the CCPA, we do not provide these deletion rights for business-to-business personal information.
In addition, if you provide us with a verifiable consumer request to correct inaccurate personal information that we maintain about you, we will use commercially reasonable efforts to correct such information in accordance with your instructions.
Exercising Access, Data Portability, Deletion and Correction Rights.
To exercise the access, data portability, deletion and correction rights described above, you should submit a verifiable consumer request to us by one of the following methods:

- Accessing your online account that you maintain with us, if the Site then has such account functionality available.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of a minor child for whom you are a parent or legal guardian.
You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative, which may include:
- Your name
- Your address
- Additional information depending upon the type of request and the sensitivity of the information involved with such request
Describe your request with sufficient detail to enable us to properly understand, evaluate and respond to such request.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or your authority to make the request and confirm that the personal information involved with the request relates to you.
We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, at your option.
If we’re unable to comply with your request, the response we provide will also explain the reasons we cannot comply with the request. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights.
Retention of Personal Information
Our policy is to retain personal information only for as long as is necessary to fulfill the reason for which the personal information was collected and as necessary to process such personal information. In addition to the above, we will retain your personal information for the purposes of satisfying any professional or legal reporting requirements to which we are subject. To determine the appropriate retention period for personal information, we consider the scope, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we collected and processed your personal information and whether we can reasonably achieve those purposes through other means, as well as any applicable legal and professional requirements.
Other California Privacy-Related Disclosures
Sharing Personal Information for Direct Marketing Purposes. Before sharing personal information of California consumers with third parties for direct marketing purposes we will obtain opt-in consent from the applicable California consumers or provide such California consumers with a cost-free method to opt out.
California Do-Not-Track Disclosure. At this time, the Site is not set up to honor web browser do-not-track settings. Do-not-track is a privacy preference that users can set in their web browsers. When a user activates the do-not-track settings in browsers that offer this setting, the browser sends a message to websites or applications requesting them not to track the user. Information on Marketing Disclosures. California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Content Removal Requests for Site Users Under 18 Years Old. If you are a Site user under 18 years of age and reside in California, you may request and obtain removal of, content or information that you have posted on the Site. You may send us any such requests by one of the following methods: (i) by email (writing “Privacy Policy/Removal Request” in the subject line) at contact-us@izipizi.com; or (ii) by writing to us at IZIPIZI. We will review the request and respond promptly. You should be aware that a request to remove content or information posted by you on the Site does not ensure or require complete or comprehensive removal of such content or information from our databases.

Changes to Our California Notice
We reserve the right to amend this California Notice at our discretion and at any time. When we make changes to this California Notice, we will post the updated California Notice on the Site and update the California Notice’s effective date. Your continued use of our Site following the posting of changes constitutes your acceptance of such changes.
N. Your EU Privacy Rights
Persons who are residents of any of the member countries of the European Union (“EU”) or are other data subjects covered by the EU’s General Data Protection Regulation, (EU) 2016/679 (the “EU GDPR”) have certain additional privacy rights under applicable law. The following provisions of this Privacy Policy provide an overview of these additional rights.
Legal Bases for Processing Personal Information

Security of Personal Information of EU Residents
IZIPIZI has policies and technical and organizational measures in place which are intended to safeguard and protect your personal information against unauthorized access, accidental loss, improper use and disclosure. However, you should be aware that information transmitted over the internet is not completely secure because of the nature of the internet and that systems and measures used to secure information are not flawless. Your Rights as an EU Resident

O. International Data Transfers and Use of Third Parties
Your personal information that is being collected by us may be transferred for further processing, access and storage to the European Union as well as in the United States. When processed in the EU, your data will be subject to the laws of the EU and the applicable member country and afforded protection under such data protection laws. When processed in the United States, your data will be subject to US federal and state law, as well as potential access by local law enforcement.
As further detailed in the Policy, we may from time to time use third parties for some of our data processing activities.
