ARTICLE 4 : SELECTION OF THE WINNERS AND DESCRIPTION OF THE PRIZES
For this Contest, two (2) random draws will be held: one for entries via Instagram and one for entries via the newsletter. Each draw will select one (1) winner, i.e. two (2) winners in total (hereinafter the “Winners”).
The same Participant may only win once. If they are drawn in both (2) draws, they shall keep the Prize won in the first draw and a new draw shall be held to select another Winner for the second.
The random draws will take place from 14 November 2026. The random draws are carried out without human intervention using random prize-allocation software, taking into account the conditions of participation set out above.
The Winners will receive the following prizes (hereinafter the “Prizes”), the indicative commercial value of which is stated at the public retail price including all taxes (incl. VAT):
- For the Instagram Winner:
- IZIPIZI Prize: A £100 IZIPIZI Gift Card – Unit value: £100 incl. VAT
- Original Duckhead Prize: A £100 Original Duckhead Gift Card – Unit value: £100 incl. VAT
- For the Newsletter (CRM) Winner:
- IZIPIZI Prize: A £100 IZIPIZI Gift Card – Unit value: £100 incl. VAT
- Original Duckhead Prize: A £100 Original Duckhead Gift Card – Unit value: £100 incl. VAT
The Winners will be notified of their win by email (Newsletter) or private message (Instagram), within a reasonable time, following the random draws.
The Prizes will be sent by post to the address provided by the Winners when entering the Contest, it being specified that the shipping costs of said Prizes will be borne exclusively by the Organising Companies.
The Prizes are awarded exclusively to the Winners, on a personal basis, and may not be transferred, whether free of charge or for consideration. The Prizes may not be exchanged. No change of any kind, for any reason whatsoever, may be requested from the Organising Companies. The Prizes may not be the subject of any request for financial compensation, buy-back or resale. In any event where the Organising Companies are unable to deliver the Prizes, no compensation will be granted to the Winners.
Only the Winners will be contacted by IZIPIZI. No information will be sent to Participants who have not won. The Winners must confirm, by reply email (Newsletter) or private message (Instagram) and within [30] calendar days, their acceptance of their Prize.
The Organising Companies cannot be held liable if the Winners cannot be reached or do not reply by email within the aforementioned period for a reason beyond their control, or do not follow the instructions set out in the Rules. In such case, the Prize will be permanently forfeited by the Winner concerned and may be reallocated to another Participant selected by a new random draw, under the same conditions.
For the purpose of delivering the Prizes, the Winners authorise the Organising Companies to carry out any checks concerning, in particular, their identity, age or postal details.
Any false statement, false indication of identity or address and, more generally, any fraudulent behaviour shall result in the immediate and permanent disqualification of the Participant and, where applicable, the return of any Prizes already sent (at the Winner’s expense).
ARTICLE 5 : PERSONAL DATA
In connection with the Contest, the Participant provides personal data to IZIPIZI (via the entry form for the Newsletter channel and, for the Instagram Winner only, by private message). IZIPIZI, as data controller, carries out processing of personal data concerning the Participant, the purposes of which strictly relate to (i) the organisation of the Contest, (ii) the sending of marketing communications relating to IZIPIZI’s products, (iii) the transfer of such data to Original Duckhead or the sending, by the latter, of marketing communications relating to its own products and (iv) the transfer of data (last name, first name and postal address) to IZIPIZI for the shipping of the Prizes to the Winners. Purposes (ii) and (iii) are only carried out if the Participant has consented thereto by ticking the box provided for this purpose when entering (opt-in). As entry via Instagram does not involve any form or any opt-in, purposes (ii) and (iii) consequently do not apply to Participants on that channel.
This processing is based, respectively, on (i) acceptance of these Rules and (ii) the express consent given by the Participant when entering the Contest.
Personal data is retained:
- for the organisation of the Contest: for the duration of the Contest, plus the applicable statutory limitation periods;
- for the sending of marketing communications relating to IZIPIZI’s products: for a maximum of three (3) years from collection, unless consent is withdrawn earlier;
- for its transfer to Original Duckhead for the sending of marketing communications: for a maximum of three (3) years from collection, unless consent is withdrawn earlier; and
- for its transfer to Original Duckhead for the shipping of the Prizes to the Winners: for the duration of the Contest, plus the applicable statutory limitation periods.
This personal data is intended for the duly authorised staff and processors of IZIPIZI and, for purposes (iii) and (iv) only, for the duly authorised staff and processors of Original Duckhead.
The Participant has the right to access, rectify, erase, object to and port the personal data concerning them, as well as the right to request the restriction of the processing concerning them. The Participant also has the right to give instructions regarding the fate of their personal data post-mortem. The Participant may withdraw their consent at any time.
To exercise these rights, the Participant may send a request by post to IZIPIZI at the following address: 19, rue de Calais, 75009 Paris, or by email to dpo@izipizi.com. The Participant may also lodge a complaint with the French data protection authority, the Commission Nationale de l’Informatique et des Libertés (CNIL): www.cnil.fr.
For further information, the Participant may consult IZIPIZI’s privacy policy, available at the following address: https://www.izipizi.com/fr-fr/policies/privacy-policy.
ARTICLE 6 : ENTRY INTO FORCE – ACCEPTANCE – ACCESSIBILITY OF THE RULES
The Rules shall enter into force as from their online publication.
Participation in the Contest implies the Participant’s full and unreserved acceptance of these Rules. In the event of any issue relating to the interpretation of the clauses of these Rules, and in any unforeseen difficulty, the dispute shall be settled at the discretion of the Organising Companies. Should one or more provisions of these Rules be declared void or unenforceable, the other clauses shall retain their full force and effect.
Failure to comply with the Rules shall result in the automatic cancellation of the entry and of any award of Prizes.
The Rules are available on IZIPIZI’s website at the following address: https://www.izipizi.com/pages/contest-rules-original-duckhead
ARTICLE 7 : LIMITATION OF LIABILITY
The Organising Companies reserve the right, for any reason whatsoever, to cancel, postpone, suspend, shorten or extend the Contest or to amend all or part of the terms of these Rules, it being understood that any amendment to the Rules will be brought to the attention of the Participants in advance.
If, as a result of a force majeure event within the meaning of Article 1218 of the French Civil Code or of an event beyond their control, they were compelled to exercise this right, they shall incur no liability.
The Organising Companies disclaim all liability in the event of any technical failure or hardware or software malfunction of any kind whatsoever (virus, bug, etc.) caused to the Participant’s system, their computer equipment and the data stored thereon, and any resulting consequences on their personal, professional or commercial activity.
The Organising Companies cannot be held liable for the postal delivery of the Prizes to an incorrect address due to the Winner’s negligence.
Furthermore, should a failure occur in the Winner selection system resulting in an excessive number of Winners being selected, the Organising Companies shall not be bound towards all Participants beyond the total number of Prizes announced in these Rules.
In the event of such a failure, the Organising Companies may decide to declare the entire Winner selection process null and void and to cancel the Contest and, at their discretion, to organise the Contest again at a later date.
The Organising Companies nevertheless reserve the option not to cancel the Contest and to award the validly won Prizes if determining the actual Winner is technically feasible under conditions that are fair to all Participants.
Once the Prize has been delivered to the Winner’s address, delivery shall be deemed to have been made and the Winner shall assume full responsibility for the Prize. In other words, the Organising Companies cannot be held liable for the loss or theft of the Prizes once the Winners have taken possession of them.
ARTICLE 8 : GOVERNING LAW AND JURISDICTION
The Rules are governed by French law.
To be taken into account, any claims relating to the Contest must be submitted in writing to the following address: 19, rue de Calais, 75009 Paris, no later than ninety (90) days after the closing date for entries to the Contest as indicated in these Rules.
In accordance with the provisions of the French Consumer Code relating to the amicable resolution of disputes, IZIPIZI is a member of the mediation service of Médiation Consommation Développement, whose contact details are as follows: Med Conso Dev, Centre d’affaires stéphanois sas immeuble l’horizon – Esplanade de France 3, rue J. Constant Milleret – 42000 Saint-Étienne. In the event of a complaint that is not resolved amicably, the Participant and/or IZIPIZI may refer the matter to the mediator at the above address or via the website: https://www.medconsodev.eu.
In the event of persistent disagreement regarding the application or interpretation of these Rules, and failing amicable agreement, any dispute shall be submitted to the jurisdiction of the Paris Judicial Court (Tribunal judiciaire de Paris).
